Privacy and Personal Data Processing Policy

Top Sky KZ LLP - hereinafter TOPSKY KZ.

1. Providing information by the User:
   1. When interacting with the TOPSKY KZ Operator or with the TOPSKY KZ Website, the User provides the following information: Last name, First name, phone number, email address and other personal data that the User voluntarily provides to the Contractor. When the Customer provides the Contractor with personal data that are special categories of personal data (for example, information about health status, race and ethnicity, political views, religious or other beliefs, membership in trade union organizations or intimate life), the consent given by the Customer when placing an Order in accordance with the procedure provided for in the Contract will be a legitimate basis to process such personal data.
2. By submitting their personal data, the Customer agrees to their processing by the Contractor, including for the purpose of promoting services by the Contractor. The Customer confirms that he is a representative of the Passengers named in the Order and who are beneficiaries under the Contract, whose personal data are processed in order to fulfill obligations under the Contract.
   1. If the beneficiary under the Contract is a child under the age of 16, the Customer confirms that a) if he is the legal representative of the child, gives his consent to the processing of his personal data when placing an Order; b) if he is not the legal representative of the child, he has received the necessary consent from such a representative before placing the Order. The Contractor has the right to require the Customer to provide confirmation of receipt of the specified consents.
   2. If the User does not want his personal data to be processed, then he must contact the Customer Service of TOPSKY KZ at the contacts indicated on the Website. In this case, all information received from the User is deleted from the TOPSKY KZ user database and the User is deprived of the opportunity to place Orders.
3. The use of information provided by the User and received by TOPSKY KZ.
   1. TOPSKY KZ uses the information:
      1. for User registration;
      2. to fulfill its obligations to the User;
   2. TOPSKY KZ has the right to send advertising and informational messages to the User.
4. Disclosure of information received by TOPSKY KZ:
   1. TOPSKY KZ undertakes not to disclose the information received from the User. It is not considered a violation for TOPSKY KZ to provide the user's personal data and relevant information to carriers, agents and third parties acting on the basis of an agreement with TOPSKY KZ to fulfill obligations to the User.
   2. Disclosure of information in accordance with reasonable and applicable legal requirements is not considered a violation of obligations.
5. TOPSKY KZ receives information about the ip address of the Site visitor. This information is not used to identify the visitor.
6. TOPSKY KZ is not responsible for the information provided by the User on the Site in a publicly available form.
